Background
The EU Regulation (Regulation (EC) No. 765/2008) on market surveillance and accreditation has been transposed into Norwegian law through the EEA Goods Act.
Havtil is the market surveillance authority responsible for the regulations that implement harmonised product directives, notably the Machinery Directive, the Pressure Equipment Directive and the ATEX Directive (equipment and protective systems intended for use in potentially explosive atmospheres). The Directives also apply to products for use in petroleum activities within the EEA, i.e. in principle, activities at onshore facilities and on fixed facilities offshore.
Market surveillance is an obligation incumbent on the national authorities to monitor products that are made available on the market in Norway. Market surveillance is performed by proactive or reactive market inspections that entail checking that products meet applicable safety requirements.
Proactive market surveillance is a planned approach in which we investigate whether products made available on the market comply with product regulations. Reactive market surveillance is performed primarily in response to incidents or suspicions that products do not meet the legal requirements.
Objective
The objective of the audit was to monitor Palfinger Marine Norway’s compliance with the regulatory requirements set forth in the product regulations, with a primary focus on offshore cranes manufactured in accordance with the Machinery Directive, as made applicable in Norway through the Machinery Regulations.
Result
The audit identified three non-conformities in the following areas:
- User manual
- Declaration of Conformity for EMC (Electromagnetic Compatibility)
- Inadequate labelling and information regarding residual voltage and stored energy in electrical installations

We have asked Palfinger Marine Norway to report to us by 31 August 2026 on how the non-conformities will be addressed.
